Upon examination of the record and the briefs, this panel unanimously agrees that oral argument is not needed. Fed. R. App. P. 34(a). John Leonard Newman, a Tennessee prisoner, filed a habeas corpus petition under 28 U.S.C. § 2254 in which he challenged the constitutionality of a 1975 conviction for second degree murder. The district court ultimately denied the relief sought and this appeal followed. The parties have briefed the issues, petitioner proceeding without counsel.
